1. APPLICATION OF TERMS
These Terms of Service ("Terms") govern your access to and use of the website operated by The Ordinary ("The Ordinary", "we", "us" or "our"), including all products, services, content, functionality and features made available through the website (collectively, the "Services").
By accessing, browsing or using the Services, you acknowledge that you have read, understood and agree to be bound by these Terms.
If you do not agree to these Terms, you must cease use of the Services immediately.
We reserve the right to amend these Terms at any time. Any amendments shall take effect upon publication on the website unless otherwise stated.
2. ELIGIBILITY
By using the Services, you represent and warrant that:
(a) you are at least eighteen (18) years of age or otherwise possess the legal capacity to enter into a binding agreement;
(b) all information provided by you is accurate, current and complete; and
(c) your use of the Services complies with all applicable laws and regulations.
3. PRODUCTS
All products displayed on the website are subject to availability.
We reserve the right to discontinue, modify, withdraw or limit the availability of any product, service, promotion or feature at any time without prior notice.
Whilst reasonable efforts are made to ensure that product descriptions, measurements, specifications and imagery are accurate, we do not warrant that such information is free from error, omission or inaccuracy.
Due to differences in display settings, lighting conditions, manufacturing processes and the inherent characteristics of textile products, variations in colour, weave, texture, dimensions and finishing may occur. Such variations shall not constitute a defect or basis for return.
4. PRICING AND PAYMENT
Prices displayed on the website may be presented in different currencies depending on your location, device settings or selected preferences.
The final purchase price and transaction currency shall be those displayed and confirmed at checkout.
Where currency conversion services are provided, exchange rates may be determined by third-party providers and are subject to fluctuation without notice.
Prices displayed on the website are inclusive of applicable taxes where required by law, unless otherwise stated.
We reserve the right to amend pricing, product information, promotional offers and specifications at any time without prior notice.
In the event of any pricing error, typographical error or other inaccuracy, we reserve the right to cancel any affected order and refund any amounts paid.
Payment must be received in full before products are dispatched.
We may utilise third-party payment processors to facilitate transactions. Such providers operate independently and are subject to their own terms and policies.
5. ORDERS
The submission of an order constitutes an offer to purchase the relevant products.
No order shall be deemed accepted unless and until we have confirmed acceptance of the order and received payment.
We reserve the right, in our sole discretion, to reject, refuse, suspend or cancel any order where:
(a) a product is unavailable;
(b) payment cannot be authorised or verified;
(c) fraudulent, unlawful or suspicious activity is suspected;
(d) an error has occurred in relation to pricing, inventory, product information or system functionality; or
(e) we reasonably believe fulfilment of the order may expose us to legal, operational or financial risk.
6. SHIPPING AND DELIVERY
Delivery timeframes are estimates only and are not guaranteed.
Risk in the products passes to you upon delivery to the delivery address specified in your order.
Title to the products shall remain vested in The Ordinary until full payment has been received.
We shall not be liable for delays arising from customs procedures, postal disruptions, courier delays, force majeure events or circumstances beyond our reasonable control.
For international shipments, you are solely responsible for all customs duties, taxes, import fees, brokerage charges and regulatory requirements imposed by the destination jurisdiction.
7. RETURNS AND EXCHANGES
Returns, exchanges and refunds are governed by our Returns Policy, as amended from time to time.
Except where required by applicable law or expressly stated in our Returns Policy, products are not eligible for return, exchange or refund due to change of mind.
Where a product is determined by us, acting reasonably, to be defective, damaged upon delivery or incorrectly supplied, we may elect to provide a replacement, repair, store credit or refund.
8. PRODUCT CARE
Customers are responsible for following all care instructions supplied with the products.
To the fullest extent permitted by law, The Ordinary shall not be responsible for damage, deterioration, colour migration, shrinkage, distortion or other adverse effects arising from improper washing, drying, ironing, storage, handling, misuse or ordinary wear and tear.
9. INTELLECTUAL PROPERTY
All intellectual property rights subsisting in the Services, including all text, photographs, artwork, illustrations, designs, graphics, logos, trademarks, trade names, product designs, branding and software, shall remain vested in The Ordinary or its licensors.
Nothing in the Services shall be construed as granting any licence or right to use any intellectual property without our prior written consent.
Unauthorised use of any intellectual property is strictly prohibited.
10. USER GENERATED CONTENT
Where you submit, upload, publish, tag, mention, transmit or otherwise provide any photographs, videos, reviews, testimonials, comments, social media content or other materials relating to The Ordinary or our products ("User Content"), you grant The Ordinary a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, reproduce, publish, distribute, display, adapt, modify, create derivative works from and otherwise exploit such User Content for advertising, promotional, marketing, editorial, commercial and business purposes in any media now known or subsequently developed.
Without limitation, this licence applies to:
(a) content submitted directly to us;
(b) content shared with us through direct messages or email;
(c) content published using brand-specific hashtags;
(d) content in which our social media accounts are tagged or mentioned; and
(e) content for which permission to repost has been requested and granted through social media interactions or other communications.
You acknowledge that The Ordinary may repost, publish or otherwise use such User Content on its website, social media channels, advertising materials, email communications, printed materials and other marketing channels without compensation.
You represent and warrant that:
(a) you own or control all rights necessary to grant the foregoing licence;
(b) the User Content does not infringe the intellectual property, privacy or other rights of any third party; and
(c) the User Content does not contain unlawful, misleading or defamatory material.
The Ordinary shall have no obligation to use, publish or retain any User Content and may remove or cease using any User Content at any time.
11. PROHIBITED CONDUCT
You shall not:
(a) use the Services for any unlawful purpose;
(b) gain or attempt to gain unauthorised access to any systems, networks or data;
(c) interfere with the operation, integrity or security of the Services;
(d) introduce malware, viruses or malicious code;
(e) engage in any activity that may impair the functionality of the Services; or
(f) infringe the rights of any person.
We reserve the right to suspend or terminate access to the Services where we reasonably believe these Terms have been breached.
12. THIRD-PARTY SERVICES
The Services may contain links to third-party websites, platforms or services.
Such third parties operate independently and are not under our control. We make no representation or warranty regarding any third-party website, platform or service and shall not be responsible for any loss or damage arising from your use thereof.
13. PRIVACY

By using the Services, you consent to the collection, use and disclosure of your information as described therein.
14. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis.
The Ordinary makes no representation or warranty, whether express, implied or statutory, regarding the operation, availability, reliability, accuracy, completeness, merchantability or fitness for a particular purpose of the Services or any products offered through the Services.
15. LIMITATION OF LIABILITY
To the fullest extent permitted by law, The Ordinary shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including any loss of profits, revenue, goodwill, business opportunity or data arising out of or in connection with the use of the Services or products purchased through the Services.
Nothing in these Terms shall exclude or limit liability which cannot lawfully be excluded or limited under applicable law.
16. INDEMNITY
You agree to indemnify, defend and hold harmless The Ordinary and its officers, directors, employees, contractors, representatives and agents from and against any claims, liabilities, losses, damages, costs and expenses (including legal fees on a full indemnity basis) arising out of or in connection with:
(a) your use of the Services;
(b) your breach of these Terms; or
(c) your violation of any law or third-party rights.
17. FORCE MAJEURE
The Ordinary shall not be liable for any delay or failure in performance resulting from events beyond its reasonable control, including natural disasters, pandemics, governmental actions, labour disputes, transportation disruptions, telecommunications failures, supplier failures or other force majeure events.
18. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
